Non residents, and foreigners are equal to Montenegrin citizens considering the issue of buying property, but with the obligatory reciprocity principle: if a resident is allowed to buy property in a specific foreign country, than a citizen of the same foreign country is allowed to buy property in Montenegro.

Concerning legal protection of property owner, all owners, foreign or domestic are entitled to the same law protection within domestic legislation.

What are the taxes and utility payments if buying or selling property?
The basis for the Real Estate trade tax is 2% of the market value of the same Real Estate . The market value is estimated by the Register, without consideration of the price stated in the contract. Also, there are expences related to the verification, request for registering propert (around 200 euros).
Is there a necessity for the personal presence in case of purchasing property and contract verification?
Buyer's personal presence, as well as personal presence in case of contract conclusion and court verification is not necessary. It is necessary that buyer or seller authorize a person, mainly lawer, with special authorization for trading, contract conslusion and signature verification.
How to check »cleanliness« of the property that is the object of buying and selling?
Real Estate »Cleanliness« can be verified by Real Estate register insight, which is a document issued by the institution responsible for property evidence, and it is reliable and accurate. Also, the »cleanliness« can be checked through information that one can gain from the owner, etc.
Is there a possibility to obtain residence permit or citizenship?
Montenegrin legislation anticipates the possibility of gaining resident permit for the foreigners that own property in Montenegro.
How long can a non-registered foreigner be in Montenegro?
One can be a month on the Montenegrin teritory without registration. After that period, it is necessary to make registration at local authorities.
